山东一职校强迫实习遭骂 学生当廉价劳动力   新华社北京9月22日新媒体专电(记者许晋豫 王志)近日,有山东圣翰财贸职业学院大二学生在网上反映:“刚上大二就被学校派去实习,每天工作12小时,工作10天只发了700元工资,部分学生出现过 敏等症状,而且不实习就不允许毕业”。相关专家指出,实习是职业教育必不可少的环节,实习过程中,学校需处理好多方关系,保障学生权益。   学生:开学就被派去实习,每天工作12小时   山东圣翰财贸职业学院是2001年成立的民办高等专科学校。近日,该校大二学生在网上发布工作场景照片、聊天记录等内容,反映开学后就被学校派 到江苏昆山的一家工厂实习,不实习就不允许毕业,每天工作12小时,一些学生出现身体过敏的症状。有学生提出,学校还对不按照要求参加实习的学生做出实习 成绩为0,缓发毕业证一年的处理。   对于上述情况,该校学生似乎见怪不怪,在山东圣翰财贸职业学院的贴吧上,网友“收信人000”说:“正常,我们当初大一就出去实训,在青岛,唯 一比你们好点儿的就是工资高点儿,每天干活时间短点儿。”还有网友表示:“这都算好的,我们大一下学期就去流水线实习了,寒假都没过。”   记者采访到山东圣翰财贸职业学院某大三学生,该学生目前正在学校指定的某企业实习,此次实习时间将长达半年多,这样的指定企业共有10家左右。 据该学生介绍,此前他上大二时也曾实习过1个多月。而且部分大一学生也会被派去实习,一些学生还曾被派到烟台某集团企业的流水线上工作,工资可达3000 多元,但是很辛苦。   “关于实习,除了要求留在实习岗位,学校没有其他要求。”有受访同学说,学生不应该过早实习,“我们在学校的时间太短,那么多学费白交了,感觉为了个毕业证不值得。”   实习是否强迫?学生是否被当“廉价劳动力”?   山东圣翰财贸职业学院副院长蒋元涛告诉记者,今年9月8日,学校组织2015级计算机类专业210名学生到江苏省昆山市某企业开展为期3个月的顶岗实习,并签订了三方协议。实习学生在企业主要从事电脑组装、检测、维修等工作。   ――每天工作时长超过8小时?蒋元涛说,学生在这家企业实习期间的正常工作时间是每天8小时,8小时外按照加班计算工资。由于最近实习企业订单较多,因此需要加班。目前,学校正在与企业协商,确保每天工作8小时,每周工作5天。   记者了解到,今年4月教育部等五部门发布了《职业学校学生实习管理规定》,并在第十六条中规定:除相关专业和实习岗位有特殊要求,实习单位不得有安排学生在法定节假日实习,不得安排学生加班和夜班。显然该学校和实习单位的一些做法已经违反了相关规定。   ――不去实习就不发毕业证?校方称,顶岗实习属于人才培养方案的必要环节,学生不参加顶岗实习或顶岗实习考核不合格者,即没有完成必需的教学环 节,不能取得毕业资格。而受访学生表示,他在升入大三后被告知不去指定企业实习则缓发毕业证一年,并表示去学校指定工厂实习也是“不敢反抗而已”。   ――学生被当成“廉价劳动力”?蒋元涛告诉记者,这批学生所在的实习企业实行计时工作制,按照每天工作8小时,实习学生的月平均工资在2400 元左右,实习学生与其他同类别员工享受同等待遇。由于企业一般每月10日发放工资,要等到10月10日才会发放第一个月的工资,不存在“十天只领到700 元工资”的情况。而受访学生表示,其工资虽能按时发放,但勉强达到同类员工工资的80%,并且“加班没加班费”。   ――实习岗位工作内容与专业不对口?有学生表示,其实习岗位与所学专业没有任何关系。校方回应称,学习计算机软件等技术离不开对计算机硬件知识 的掌握,这批学生的实习岗位与所学专业对口或相近,不存在学生实习工作与专业毫无关系的问题。对此,北京师范大学(分数线,专业设置)教育学部职业与成人教育研究所教授和震 说,大三之前学生处于熟悉工作流程阶段,专业不对口无可厚非,但是大三的实习则要与所学专业对口。   ――三方协议能否保障学生权益?针对学生质疑三方协议没有约定学校对学生的义务,担心一旦发生事故学生权益将得不到保障。校方回应,实习期间学 校已为学生购买保险,并且实习学生作为在籍学生,一旦发生意外,即使三方协议没有将相关事项列入,学校也会根据相关法律法规承担相应的责任。   专家:实习必不可少,校方需保障学生权益   对于高职院校学生实习过程中遇到的一系列问题,专家认为,实习是高职院校教育计划中必不可少的环节,但高职院校必须围绕培育人才这个核心,处理好各方的关系,切实保障学生权益。   “国内不乏劳动密集型企业,找到实习单位虽易,但提高实习质量是职业学校的责任所在。学校要围绕培养人才这一核心处理好与企业、学生的关系,保 障学生权益。”和震说,产教结合、校企合作已得到世界各国职业教育的认可,我国的职业教育经过多年的探索,在校企合作方面取得了不错的成绩,不能因为一些 学校出现问题而全盘否定。   在实习过程中如果遇到侵权行为,学生该如何维护自身的合法权益?北京炜衡律师所律师罗宇华说:“学生与实习单位未建立起真正的劳动关系,所以不能由劳动法来调整,只能按照一般民事行为来处理。就实习中存在不合理情况,建议学生可向当地教育部门投诉。”   蒋元涛表示,针对此次学生实习中出现的问题,山东圣翰财贸职业学院将从强化实践育人功能,把学生实习与专业人才培养目标紧密结合,强化专业人才培养方案的严肃性;建立健全校企合作共同育人的管理体制;注重学生合法权益的保护;推动学生实习的全方位管理等方面不断改进。相关的主题文章:
